Paintsville police were called to an apartment where a man had apparently passed out and was feared to have overdosed.
Police found James N. Moore who woke when the officer shook him.
Moore showed signs of severe impairment and the officer said he saw marijuana.
Moore was arrested at that time.
The Herald reported that Moore currently has at least three active cases listed by the Kentucky Court of Justice in Johnson County.
